1. Agreement to Terms

By accessing or using ShieldMyShop ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ShieldMyShop provides compliance scanning services for Etsy sellers. Our service:

  • Scans your Etsy listings for potential trademark and policy violations
  • Provides risk assessments and recommendations
  • Offers monitoring and alerts for compliance concerns
  • Generates compliance reports

3. Important Disclaimers

ShieldMyShop is NOT a legal service and does NOT provide legal advice.

  • No Guarantee of Compliance: Our scans identify potential issues based on known trademarks and Etsy policies, but we cannot guarantee your listings are fully compliant. Trademark law is complex and constantly evolving.
  • Not Legal Advice: Our recommendations are informational only. For specific legal questions about trademarks, intellectual property, or compliance, consult a qualified attorney.
  • No Liability for Suspensions: We are not responsible for any Etsy suspensions, takedowns, or other actions taken against your shop, whether or not you use our service.
  • Database Limitations: Our trademark database covers common high-risk brands but is not exhaustive. New trademarks are registered daily.

4. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be an authorized Etsy seller or have permission to scan the connected shop
  • Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account.

5. Etsy Authorization

By connecting your Etsy shop to ShieldMyShop, you:

  • Authorize us to access your shop data via the Etsy API
  • Confirm you have the right to grant this access
  • Understand we use read-only access and cannot modify your listings
  • May revoke access at any time through your Etsy account settings

6. Subscription and Payment

Free Trial

New users receive 3 free scans. No credit card is required for the free trial.

Paid Plans

  • Subscription fees are billed monthly or as a one-time payment (Lifetime plan)
  • Prices are in USD and do not include applicable taxes
  • Payments are processed securely by LemonSqueezy
  • You authorize us to charge your payment method on a recurring basis

Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of your current billing period
  • No refunds are provided for partial months
  • Lifetime purchases are non-refundable after 14 days

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account with others or resell access
  • Attempt to reverse engineer or extract our trademark database
  • Use automated tools to access the Service (except as authorized)
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent any usage limits or access controls
  • Misrepresent your affiliation with any shop you scan

8. Intellectual Property

The Service, including its design, features, and content, is owned by ShieldMyShop and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute any part of the Service
  • Use our branding without permission
  • Create derivative works based on the Service

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
  • WE ARE NOT RESPONSIBLE FOR ACTIONS TAKEN BY ETSY, TRADEMARK HOLDERS, OR OTHER THIRD PARTIES AGAINST YOUR SHOP OR LISTINGS.

10. Indemnification

You agree to indemnify and hold harmless ShieldMyShop, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content in your Etsy listings

11. Service Modifications

We reserve the right to:

  • Modify or discontinue the Service (or any part) at any time
  • Update features, pricing, or terms with reasonable notice
  • Suspend accounts that violate these Terms
  • Refuse service to anyone for any reason

12. Termination

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • Required by law or third-party request

Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be:

  • First attempted to be resolved through good-faith negotiation
  • Subject to binding arbitration if negotiation fails
  • Governed by the laws of the jurisdiction where ShieldMyShop operates

You waive the right to participate in class action lawsuits or class-wide arbitration.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ShieldMyShop regarding the Service.
